1. Acceptance of Terms

By accessing or using EstateRuth ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

EstateRuth is a platform for item research and valuation. The Service includes AI-powered identification, comparable-sales research, valuation reports, and public discussion around those reports.

3. Accounts

You must create an account to use certain features, including managing report visibility, posting comments, and purchasing or using research credits. You are responsible for maintaining the security of your account and for all activities that occur under your account.

You must provide accurate information when creating your account. You must be at least 13 years old to use the Service.

4. User Content

You retain ownership of all content you upload (photos, descriptions, notes, and report inputs). By posting content, you grant EstateRuth a non-exclusive, worldwide license to display, distribute, and process your content as necessary to provide the Service.

You represent that you have the right to upload all content you submit and that your content does not violate any laws or third-party rights.

5. AI Pricing & Identification

EstateRuth uses AI to suggest item identifications, descriptions, and prices. These are estimates only and should not be relied upon as professional appraisals.

AI suggestions may be inaccurate. EstateRuth is not responsible for decisions you make based on AI suggestions, valuations, or comparable-sales research.

For items of significant potential value, we recommend consulting a professional appraiser.

6. Prohibited Uses

You agree not to:

  • Use the Service to sell illegal items or conduct illegal activities
  • Upload false, misleading, or fraudulent content
  • Attempt to access other users' accounts or data
  • Scrape, crawl, or automatically collect data from the Service
  • Use the Service to harass, abuse, or harm others
  • Interfere with or disrupt the Service
  • Resell or commercially exploit the Service without permission

7. No Marketplace Transactions

EstateRuth is not a marketplace, broker, or auction house. We do not process item sales, handle shipping, or mediate transactions between buyers and sellers.

Any buying, selling, donation, or consignment decisions you make based on information from the Service are your responsibility.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. EstateRuth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid to EstateRuth in the 12 months preceding the claim, or $100, whichever is greater.

9. Account Deletion

You may delete your account at any time through your Profile settings. Upon deletion, we will permanently remove your personal data, reports, uploads, and photos within 30 days. Some anonymized, aggregated data may be retained for service improvement.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Travis County, Texas.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes.
